Terms of Service
1. Definitions and scope of application
1.1. These Terms of Service set out the conditions for using the SafeKit service (hereinafter the “Service”), available at https://safekit.net, provided by Kysune Sp. z o.o., ul. Księcia Witolda 49/15, 50-202 Wrocław, Poland, VAT ID: 8982302415 (hereinafter “Kysune”, “we”, “us”, or “our”).
1.2. “User” means any natural or legal person using the Service. Using the Service constitutes acceptance of these Terms of Service.
1.3. The Service provides online tools (e.g., password generators, file converters) free of charge. Registration or providing personal data is not required. We reserve the right to make some tools available as paid services under a subscription plan, accessible after logging in.
2. Nature and availability of services
2.1. The tools in the Service are provided on an “as is” basis. We will make every effort to ensure the proper operation of the Service, but we do not guarantee its availability, uninterrupted functioning, or compliance with Users’ expectations.
2.2. Kysune reserves the right to modify, suspend, or discontinue the Service or any of its functionalities at any time, without providing reasons. The User does not acquire the right to permanent access to the tools provided.
3. Rules of use and User obligations
3.1. The User agrees to use the Service in accordance with the law, these Terms of Service, and good practice, in a manner that does not disrupt the operation of the Service or infringe upon the rights of third parties.
3.2. The User may not use the Service in a way that could cause harm, including introducing malicious software, abusing resources, or breaching security measures.
3.3. The User bears sole responsibility for the consequences of using the results generated by the tools. The User undertakes to verify the results and adapt their use to personal needs and applicable laws.
4. Third-party services and content
4.1. The Service uses external providers, such as OVHcloud hosting and CloudFlare security and CDN services. The User acknowledges that these entities may collect and process basic technical data (e.g., IP address, request data) in accordance with their own privacy policies.
4.2. The Service may contain links to third-party websites or services. Kysune is not responsible for the content or services provided by such third parties; using them is at the sole risk of the User.
5. Disclaimer of warranties
5.1. To the maximum extent permitted by law, Kysune disclaims all warranties, guarantees, and conditions, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
5.2. The User acknowledges that use of the Service is at their sole risk. The results generated by the tools should be treated only as auxiliary and verified before practical use.
6. Limitation of liability
6.1. To the maximum extent permitted under applicable law, Kysune shall not be liable to the User or any third party for any direct, indirect, incidental, special, or consequential damages (including loss of profits, data, or business interruption) arising from the use of, or inability to use, the Service.
6.2. Kysune is not liable for errors resulting from the use of the tools, including incorrect file conversions, inaccurate results, or data loss. The User agrees to independently verify the correctness of the results.
7. Changes to the Terms of Service
7.1. Kysune reserves the right to amend these Terms of Service at any time. Information about changes will be published on the Service website.
7.2. The amended Terms of Service shall enter into force upon publication. Continued use of the Service after changes have been introduced constitutes acceptance of the new Terms of Service.
8. Governing law and dispute resolution
8.1. These Terms of Service and any disputes arising from them are governed by Polish law.
8.2. Any disputes related to the use of the Service shall be resolved by the competent common court having jurisdiction over the registered office of Kysune.
